QUEEN MARY GOES BANKRUPT

Read my review when I visited the ship in long beach in december, and said then I felt the ship was in "managed decline".... it was not that surprising for me to read that it had filed for bankupcy protection...

"LONG BEACH — It took the city and the Queen Mary's operator nearly two years to confirm that they were miles apart on a lingering rent dispute that has reached $3.4 million.
But with Queen's Seaport Development Inc. filing for Chapter 11 bankruptcy protection this week, legal observers say the issue may come to a relatively quick resolution.

"Chapter 11 generally takes about 10 months to a year on average," said Lynn Lopucki, a UCLA bankruptcy law professor. QSDI's bankruptcy filing marks the latest twist in the Queen Mary's complicated history as Long Beach's iconic tourist attraction. Observers said the bankruptcy case also has some unusual aspects.

But bankruptcy lawyers and professors said the $3.4 million in dispute and another $389,000 that QSDI owes its 20 largest unsecured creditors, according to its filing, are relatively small amounts for a Chapter 11 proceeding.

"I wouldn't characterize the Queen Mary as a larger case," said Randye Soref, a Los Angeles bankruptcy attorney with the law firm of Buchalter, Nemer, Fields & Younger. "I'd just characterize it as a high-profile case."

QSDI, which leases the city-owned Queen Mary and its surrounding 55 acres, filed for bankruptcy protection on Tuesday. The move allows the company to continue running the ship while the rent issue is resolved.

The filing came the day before a city deadline for the company to pay $3.4 million in rent back to 2000, a demand QSDI disputes. QSDI's attorney, Joseph Eisenberg, said the filing allows QSDI to continue operating the ship without the city terminating the company's 66-year lease or filing a civil lawsuit for the money.

In a Feb. 24 default notice to QSDI, the city said it was prepared to take "all available legal remedies" to collect the money. The notice gave QSDI 10 days to pay, although the city later extended the deadline to March 16. The bankruptcy filing effectively moved the issue to federal bankruptcy court instead of a likely date in county superior court.

U.S. Bankruptcy Court Judge Vincent Zurzolo will now be tasked with sorting out a mess that the city and its tenant have been unable to resolve. Several observers said the fact that the case is in bankruptcy court may bode well for QSDI.

"Bankruptcy courts are generally thought to be a more favorable court for a debtor," Lopucki said. Still, aspects of the case are unusual, he said. Lopucki estimated that 5 percent of Chapter 11 filings involve disputes over the debt that initially sparked the bankruptcy filing.

"Most bankruptcies are generally to deal with undisputed debt," he said.

But Soref, who represents creditors in bankruptcy cases, said it's not that uncommon.

"In my world, I see that all the time," she said.

By filing for bankruptcy protection, QSDI must seek court approval before it can spend money, even for its day-to-day operations. The company was in court Friday and won approval to make four weeks of costs, including operating and maintenance expenses, and employee paychecks.

The issue of whether the company owes the city past rent could move toward a resolution within 60 days, attorneys for both sides said. Under bankruptcy provisions, QSDI can file a motion to assume the lease within that time frame, a process that would require a decision by the judge on the merits of the dispute.

But before that happens, the city will likely get a closer look at the company's expenses. By March 30, QSDI will be required to list its assets and liabilities, although Soref said debtors can seek an extension. With its Tuesday filing, QSDI listed its 20 largest unsecured creditors, which included debts as of that day to attorneys, accountants and utilities, among others. It also included a variety of vendors including a Shafter, Calif., fireworks company that QSDI owes $8,900.

The city was not listed as a creditor, which Wesley Avery, a bankruptcy attorney hired by the city, said was unusual. Eisenberg, QSDI's attorney, said the city wasn't listed because the company disputes the city's rent claim.

Joseph Prevratil, QSDI's president and CEO, has leased the ship since 1993. Prior to QSDI, several companies, including The Walt Disney Co. and Wrather Corp., held and later backed away from the lease. City officials have hoped development of the surrounding acres would spark attendance and interest in the historic ship, although past development plans have failed to materialize.

The rent dispute centers around credits that QSDI has claimed under a provision of an amended lease signed in 1998. That lease provision allowed the company to keep up to 9 percent of whatever it spends to develop land around the ship.

City officials say QSDI took credits since 2000 for work not eligible under that provision, including improvements to the ship itself. The company says its credits met the lease terms and that city-signed documents back their case.

The sides have been informally arguing over the issue since 2003, although they recently spent nine months in formal talks in search of a solution. Those talks ended with the city's Feb. 24 default notice.

Regardless of the outcome, the parties have one thing in common: They're both looking outside for their legal help.

QSDI has paid Eisenberg $100,000, according to the company's bankruptcy petition. He works for Jeffer, Mangels, Butler & Marmaro in Los Angeles.

The city, meanwhile, has retained Ezra, Brutzkus & Gubner, an Encino-based bankruptcy law firm. Long Beach has yet to pay $100,000 in the case, although the City Council will be asked to approve the firm's expenses if that threshold is crossed, City Attorney Bob Shannon said."

Dame Kelly Holmes to Name P&O Cruises Arcadia - Britain's Newest Superliner



Double Olympic gold medallist Dame Kelly Holmes is to name the largest superliner to be built exclusively for Britain - Arcadia, the latest addition to the P&O Cruises fleet. Dame Kelly will become Arcadia's official Godmother in a spectacular evening ceremony that will take place in Southampton on 12 April 2005.

Commenting on the announcement, David Dingle, Managing Director of P&O Cruises said,

"Dame Kelly Holmes' triumphs in last year's Olympic Games were outstanding achievements for Britain, and we are honoured that she has agreed to become Godmother to Arcadia. In keeping with Arcadia's modern and innovative values, her naming ceremony will be a departure from tradition. Dame Kelly will perform the customary champagne naming but the celebration will encompass grand scale theatre and dramatic surprise, as well as stunning pyrotechnic displays.

A child-free ship, Arcadia will feature an expansive spa with a thermal suite and hydrotherapy pool, three-tier theatre, 3,000 piece multi-million pound modern British art collection, 14 bars and six fine dining options including Arcadian Rhodes, a restaurant developed exclusively for P&O Cruises by renowned chef Gary Rhodes. Carrying 1952 passengers and a complement of 880 crew, she will sail
to destinations in the Mediterranean, Atlantic Isles, Baltic, Norwegian Fjords, USA, Caribbean and Central America.

Arcadia has 540 metres of promenade deck which will be popular with joggers; for the more serious, this distance can be covered by Dame Kelly in just one minute 18 seconds based upon her 800m gold winning time in Athens.

ARCADIA HAND OVER FROM 20 MARCH..

I read this on cruise connections:

Fincantieri will officially handover Arcadia to P&O Cruises on March
20. She will be named on the evening of April 12 at a yet undisclosed
location.

All invited guests have to embark by 5:00pm at The Mayflower Cruise
Terminal

The ship will then depart to the 'naming celebration location' at
which guests will disembark for a shoreside gala reception, which
will take place between 7:30-8:30pm. Then she returns to Mayflower
Cruise Terminal

Any ideas where the naming celebration will be? Surely they can't be
just going to the QE2 terminal to tie up, get everybody off, name the
ship and then return to the Mayflower terminal? I notice Oriana is
in the QE2 terminal until 5pm so they could have swapped the two
ships locations easily.

Any ideas??

QE2 FUTURE... MORE THOUGHTS

The discussion continues on the message baords and Yahoo groups about what shoudl ro should not happen to the QE2. I guess pretty much everyone has cometo accept that the ship years are numbered.

Pete has an interesting view:

"There could be some resistance to QE2 being used as a
conference/hotel centre in Japan. The original Queen Elizabeth was on her way to Japan via Hong Kong when she was arsoned.

Becoming a hotel etc - it's already been done with Queen Mary and the
original Queen Elizabeth was tried as a hotel in LA, but it didn't
work out.

Finding a suitable resting place for QE2 is further hampered by her draught of 32 feet. Not many harbours in popular locations can accomodate her.

Sending her to breakers in Alang would be an unbecoming end to such
an icon, which leaves very little choice. Look at SS France and nobody wants her....... she's off to be scrapped soon.

Now, if they took QE2, scrapped her and with it made a QE2 Version 2 - THAT would be welcome (to me"

He is not 100% right on the QE story as she was being converted into SeaWise University when she was arsoned. The original QE being one of the chapters in a book I am writing at the moment!!! More on that in a future posting....

QE2 BEING ACTIVELY RUN DOWN?


There has been more and more discussion on the boards after the comment that is doing the rounds that the QE2 may be earmarked for eventual sale to Japan for a floating hotel.

This posting caught my eye on cruisecritic, as the poster also speaks about Cunard brochures and trends in the marketing. A topic that I plan or hope to write a book about. I am collecting Cunard brochures from the launch of QE2 onwards. I ahve quite a lot so far!!

Here was the posting by QueensFan: "Hello! I'm a 15-year-old newish CC member (I've been lurking as registered for a few months). As you can tell from my username, I am a fan of all four Queens (QV doesn't count as a queen to me, more like the rebel force that tried to take over the monarchy, but will ultimately fail.), with QE2 my absolute favourite.

I have dreamed of a transatlantic QE2 crossing since I was 10. I have every Cunard brochure from 2000-05, except for a few of the earlier World Cruise ones (still looking!). Every year, when one arrives in the mail, I pour over the pages, dreaming.But I've noticed another thing, when looking back at these brochures. Between 2000-03 (QE2's "golden glory years"), QE2 was always the main focus of the brochures, the cover photo, the most pages. You could really tell she was the greatest in the world, and Cunard really promoted her in the limelight.But then, QM2 came in. At first, with my original QM2 brochure, she seemed like no threat - hey, another Queen to join QE2! But then my 04 brochure came. And I noticed something immediately.As you could say, the adjectives went to QM2. The "glorious" QE2 became "memorable". The "once-in-a-lifetime" experience became "amazing". And all the good ajectives went over to the QM2 section of the brochure, many of them changed into superlatives.

Basically, Carnival/Cunard is killing QE2. She was a powerful revenue source before QM2, pumping in money. Now, they have 100% focus on QM2. They even sold off their "useless" ship, Caronia, going for an "all-Queens" line.

Obviously, Cunard is trying to dump QE2, because she's older and unpopular. But they don't realise that they did this to themselves.

I've noticed that all the complaints about her condition are post-QM2. This just proves it.Carnival/Cunard should wake up to this. If they put a few million into QE2, and start promoting her more, they could recreate her as the cash cow she was before. They have something going with the last classic liner thing. The thing is, this could also never happen.

They've gotten QM2 obsessed. The world is QM2 obsessed. QE2 lost her luster.But I think that, if they really put into it, they could keep her onboard. I could see another 10 years (mechanically) for the ship, maybe even 15. Who knows, I could honeymoon on the QE2 one day. But only if Carnival/Cunard really cares about her.

The latest rumour is that Japan wants her. I think that would be terrible. Although it's better than scrapped, I feel that, when she does retire, she belongs in one of two places: Southampton, her home, or Long Beach, docked next to the Queen Mary.But I'm hoping that that day is long into the future. I'm hoping to see the QE2 in my 2008, 2009, and 2010 Cunard brochures, and not under "Cunarders of the Past" " Posted by Hello

BYE BYE QE2 TO JAPAN?


The well know writer and marine historian writes email news letters, here is an extract that someone posted with news on the QV and importantly the QE2 that is based on stories on his current trip on the Qm2:

"In other news, the 90,000-ton Queen Victoria has been delayed, or so it seems, yet again. The delivery date is now set for January 2008, but some insiders say that it might not be until 2009 or even later. Meanwhile, rumors continue that the 36-year-old Queen Elizabeth 2 will leave service by December 2007 and that a museum-hotel complex in Japan might be her fate. Commodore Ron Warwick wants to head a campaign to save the beloved 963-foot long Cunarder."

QM2's 2005 enrichment programs

"Guests of Queen Mary 2's transatlantic crossings are in for more than a treat in 2005. In addition to the vessel's much anticipated "Chefs at Sea" program sponsored by Gourmet Magazine, this year's on board enrichment offerings will feature guest speakers sponsored by Architectural Digest, House & Garden and the New Yorker.

Continuing the successful collaboration with Architectural Digest, the ship is pleased to welcome William Stubbs, author of I Hate Red, You're Fired, on the eastbound May 28 transatlantic crossing. Chronicling his design journeys from Acapulco to Moscow, his book illuminates why Architectural Digest hails Stubbs as one of the top 100 Designers today. The September 20 westbound sailing will see the arrival of celebrity designer Roderick Shade, who counts Star Jones as one of his top clients.
